Terms & Conditions

Please read these terms carefully before downloading or using our digital embroidery designs. Last updated: August 2026.

Important Notice: By downloading, purchasing, or using any digital embroidery design files from TexStitch, you agree to be bound by this Agreement. If you do not agree to these terms, please do not purchase or use our products.

1. Digital File License & Usage

All embroidery designs, vector files, and digitizing files on this portal are the intellectual property of TexStitch. We grant you a non-exclusive, non-transferable, single-user license to use these designs.

  • Permitted Use: You may stitch our designs onto physical fabrics, items, or garments and sell those physical items commercially.
  • Personal Use: You may modify the size or colors of the design to suit your production needs.

2. Strict Prohibited Activities (Zero Tolerance)

Sharing or reselling digital files leads to direct financial loss for our designers and platform. We enforce strict measures:

  • You may not resell, sub-license, gift, share, copy, or redistribute the digital files (DST, PES, EMB, etc.) in any format or through any media (including WhatsApp/Telegram groups, drive links, or social platforms).
  • You may not upload these digital files to print-on-demand websites, digital marketplaces, or file sharing platforms.
  • Violation of this section results in immediate account termination, permanent forfeiture of access, and potential legal action for copyright infringement.

3. No-Refund Policy & Chargebacks

Due to the digital nature of embroidery files, they cannot be physically returned once purchased or downloaded.

Therefore, all sales are final and non-refundable.

If you encounter a corrupted file or technical error, please contact our support team. We will correct the file and deliver a working copy promptly. Initiating fraudulent chargebacks or dispute claims through payment gateways will trigger automatic account deletion.

4. Mandatory Test Stitching & Limitation of Liability

You MUST run a sample test stitch on scrap fabric before sewing on your final product or executing mass production.

Embroidery results vary depending on the combination of fabric, stabilizers, needles, threads, tension, and machine models. TexStitch is NOT liable for fabric damage, thread waste, needle breakage, machine damage, or loss of profits due to untested stitching runs.

In no event shall our total aggregate liability exceed the purchase price of the specific digital design file that caused the dispute.

5. Governing Law & Jurisdiction

These terms are governed by and construed in accordance with the laws of India. Any legal disputes or claims arising out of or related to these terms or your use of our digital products shall be subject to the exclusive jurisdiction of the courts located in India.
